She is a receptionist at a small branch. Then I hear a rumour that the boss is actually considering replacing her with someone who will do half day job

Re: Redundancy issues

Thanks for all the comments. Therefore, if the post is redundant and no other suitable role if available to offer, they can be forced to leave (obviously with the relevant legal financial compensation which is not very much unless you've been there a very long time and are on a good salary). You cannot then give the same job to another - the person being made redundant would have extremely good grounds for taking them to tribunal and winning! If the person is offered a "reasonable" alternative, such as reduced hours or at an alternative surgery within "reasonable" travelling distance and declines, then that's ok to fill the gap with someone else. I know this for sure as had a similar situation with someone we had to get rid of when I was at the RSPCA and you have to be SO careful to do things by the book!

I have typed "reasonable" in inverted commas because this is what the law states and is often a grey area - it's open to a certain amount of interpretation! As an example, an eforced change of contract has to be given a reasonable period of notice - this is usually deemed to be 3mths.

Re: Redundancy issues

yeah, I told her to go to CAB. I think its illegal though, as far as I know, redundancy is when they have no need for that post anymore.... so that means you cannot recruit someone in your place.

Re: Redundancy issues

From conversations I have had with my sister who was made redundant from a computer firm a few years ago, they do have to offer you if they are making a slightly different position. Speak to CAB

This might sound stupid, but surely it makes more sense to keep someone who knows how to work comps ect than take someone new on

Re: Redundancy issues

Don't know all the ins and outs but definately doesn't sound right..... tell her to go to the CAB - Citizens Advice Bureau or equivalent ....

Re: Redundancy issues

Im not 100% sure but I thought they had to offer an alternative position if they wanted to make redundant.
