That sounds like a really good idea Sal, hope it makes your life easier! Unfortunately we dont have a landlord as we own our flat. They are leasehold though so the housing association are aware of the situation and are writing to the idiot to warn him he is breaking the terms of the lease.
Got home from work to find the TV upstairs turned off
But got up this morning to find note on my car telling me not to park on the drive. Its a long story but the drive we thought was ours isnt, we have been parking on it as the owners dont have a car and no one else uses it. Not sure why they couldnt just come and knock on and tell me they needed to use the drive. We now have a wrecked boy racer car to look at through front window!
And to cap it all off, the witch who used to live upstairs and we also had lots of trouble with, has moved into next door but one!!

Sorry, I realise I'm ranting but its making me feel better! Feeling really stressed out by the whole situation

That's a really good idea Sal. I would definately sign up to something like that but it's just a shame that they could make it part of the tennancy agreement.

the residents of my block of flats (council property) are in the middle of creating a 'good neighbour agreement' - it is voluntary and contains such things as not using washing machine after nine at night, residents are accountable for their visitors (and any damage they cause) , no noise on the stairs after 10 at night. No loud parties, loud music or using the xbox with the volume up full all through the night, no dumping rubbish on the landings and definitely no growing cannabis or dealing drugs, no smoking on the landings etc etc and I am pretty pleased because I am one of the people who proposed it. (tho i may not live to regret it ) . The important thing is that all residents have been consulted and together (well the ones wanting to take part) have come up with a list of things we think can be improved upon)

The council have taken to the idea really well and are ready to roll it out through the rest of the blocks if I can prove it will work here. I say it is voluntary but that isnt strictly true. Its voluntary to sign the agreement - and anybody who has signed and persistently contravenes the agreement then the council have grounds to use the legal system to evict them. Residents who dont want to sign the agreement and carry on acting like t**ts well then the council can say that they have decided not to participate in a good community and their behaviour is then grounds for eviction.

maybe this system would work with your neighbour? is it worth asking your landlord?

I know exactly how you are feeling and have every sympathy.

I had extremely noisy neighbours - I also used to live in a flat but 2 of my neighbours were inconsiderate t**ts and it seemed to get worse when I had my little boy. The people that lived downstairs were just nasty and used to bang on their ceiling in the room my son was asleep in to wake him up - shout and carry on all night and day and have their tv on full blast and the people next door used to come home @ 2/3am and decide to have a party.

I can't understand why people are so inconsiderate these days it really angers me because you always feel that absolutely nothing is getting done. I went down all the right routes etc but in the end couldn't cope with lack of sleep and also having a very tired and upset child that I just moved.

I now have a lovely neighbour - who had had exactly the same problems as me prior to me moving into the house so we are all considerate of each other.

Just a shame that it's always the victims of these situations that seem to have to up sticks and move. I am glad I did though cos am much happier now.

Well we managed to get hold of the man who manages the landlords properties. He is in Blackpool and can't do anything tonight. He contacted the neighbour who is away, home tomorrow and he said the tv must have turned itself on
OH has told him its really out of order so will await the fun and games tomorrow!
Sofa for me tonight if I want some sleep

Noise pollution is to do with the council - you are quite right (specifically environmental health if its the same as the council here) Environmental department do have the power to involve the police as do the anti social behaviour department (which may or may not be seperate to the environmental department - always lots of departments spending the money that comes in from your council tax ). AND your landlord also has a responsibility to you if you are a tenant and if they fail you they can also be held legally liable

Oh my I really do have sypathy for you.! one of my old neighbours had a 48hr party!!! he lived on the top floor and peeps were running up and down the stairs the whole time!!! It drove me and my other neighbours mad!! Playing the same CD over and over again!!! Our landlord failed to do sweet FA saying that it was better for us to sort it out between ourselves!!!!

Every time someone went past my door I would get up and tell em where to go! Good knows how I coped with very littel sleep and continued to work!

Noise pollutions is the councils area though I think? Not sure but police less than hopeful last time. If still in same situation tomorrow I will be acting as the concerned neighbour!

Me and Mr Tibbles will be curling up with a quilt on the sofa tonight, getting some quality time in while OH is away.

Looby, after the problems you had lastnight and lack of sleep, I think it would do you the world of good if you were able to have an early night and your wee kitty curled up with you.

That was why I was wondering was the tv still on? Surely the police can so something about it, it should be noise pollution or something

TV is still on and still no sound of life up there. Managed to get hold of a number for a man who manages the flat (landlord is in spain!) so OH going to try and ring him.
We've rung the police before about loud music and they say theres nothing they can do as its in a home, not a business etc.

Kitty is just old with lots of related problems, he's been a bit quiet last few days and breathing a bit heavy last night. He's just had some tea and curled up on my knee so no visit to work tonight. Do feel like Im just putting it off though, dont think I could cope tonight, not while Im on my own, with no sleep and a banging headache.

I am not sugesting for 1 minute you do the following - really I am not. .... But could it be that you are really worried about your neighbour as his tv has been on for almost 24 hours and you havnt heard him at all and are really worried something may have happened to him - well thats what I would be telling the police anyhow might get the telly turned off for you if nothing else!

do you have any other neighbours nearby at all? - what are their thoughts?

How funny that you bumped this up just now, it seems my lovely neighbour has gone away and left his tv blaring at full blast

Saw him leave with a holdall at 8 last night, never heard him come back, went to bed to tv blaring out upstairs. drifted off about 2 am then it woke me up again at 3. I went up and banged on door several times, no answer. Woke my OH half up getting in a huff so he went up and very nearly bashed the door off its hinges! If neighbour was in there was no way he wouldnt have heard that, even if asleep. Finally fell asleep at 4, up again at 7 so like a zombie at work. TV still blaring out and havent heard any signs of life from upstairs so seems like he has gone away and left tv on
Reported him to housing association again who are going to contact him re breaking terms of lease and warn him he will be monitored.

And to make it worse the other half is working away tonight and think its time my old cat went to ktty heaven
just want to crawl under my duvet and not come out for days

Thanks for all the replies, still feeling really stressed with it all
We own our flat and the one upstairs is rented out, the owner lives in spain but I have an email contact. As the flats are leasehole we have a housing association and have terms on the lease about things like this. Basically no tele/ radio etc between 11.00pm and 8.00am. Although it isnt strictly enforced they will do when problems. I reported him to our housing association who hold the lease and they will send him a warning letter. If there are still problems they will open an antisocial behaviour investigation!! Sounds like it may get worse before/ if it ever gets better.

Feeling upset cos was really looking forward to arranging a wedding but may have to put on hold. Trying to number crunch to see what we can do.

i really feel for you we have recently got rid of our very noisy, drug smoking, pit bull owning neighbourghs. They were living in the rented house next door (terrace). If he is renting then complain most lanlords are very helpful as we found out.

If you cant get rid I would move it put a serious strain on me and my partners relationship. We would both strop at each other even though we were mad at the neighbourghs. At the end of the day you need to do whats best for both of you, hope it goes well

Not sure what the correct answer to this is, but you've both been together such a long time, surely being happy together is most important? Neighbours are a nighmare, just try and remember to live for now and your meant to be together, whether u get married now or a few years down the line?

Hiya! Difficult decisions eh? Don't envy you! Is the t**t living in rented or has he brought the flat? Can you just hang on abit, don't react to him and see what happens? If he lives in rented, can you find out who his landlord is? Not much help I'm afraid but feel for you............
