No but they can sue you for the cost of a locum nurse to replace you, if you don't work your notice - I know cos this happened to a friend of mine.

god 3 months is crazy!, I have to give 2 months, but I know if I didnt want to be there they would let me leave as soon as feesable!?, not point making someone stay who isnt happy!

I know practices are finding it hard to replace qualified nursing staff that hand in notice, and I know that it can take a time for the new nurse to settle in - but 3 months!

if it takes 3 months could it be that

a) the practice has very exacting standards, that cannot always be reasonably met?

b) the practice finds it hard to recruit because basically it has a bad reputation for whatever reason and nobody wants to work there anymore?

(and this may equally not be the case - but I have seen this so many times before)

If a practice goes to the trouble of stipulating a 3 month notice period it would suggest to me that they have a major staff retention problem and maybe it would be time for them to look at exactly what that problem is and how they can solve it?

Many places I know do not give a contract until the job has been accepted, then you are left with the choice of leaving the job as soon as you start if you dont like the contract (remembering that you have already ceased to work for the employer before) or putting up with stuff you dont like until you find another position

I was with my practice 5 years and had to give 5 weeks notice - very much depends on your contract but would agree 3 months is steep esp only have been their 7 m- depending on your role of course.

If you didnt work your full notice would think would affect your pay - but if this position is what you really want there would be no way i would let it slip.

Try and negotiate with them because I don't think there is anything legally they can do to hold you to the practice for the next three months. Six weeks maximum is more than enough really, though your next practice should be aware that you're leaving your job in less time than they stipulated on your contract. Therefore it may affect references etc.

Seriously, would any future employer be prepared to wait for 3 months for their new staff?? Crazy! Hope you get it all sorted out soon.

hi bex,

what is your role in the practice?

usually if you have an important role, e.g. head nurse etc, your notice period is longer to give the practice time to replace you.

3 months seems a bit long, but i'm sure if you found the job of your dreams you can come to some arrangement with them.

at the end of the day though, your future is the most important thing, don't let a great job go because your current job is holding onto you. i'd give a reasonable amount of notice, ?6 weeks?, and go.

3 months is crazy! I have a months notice on my contract, it was supposed to be 2 but i wasn't happy with that so it was changed.

Thats why they put crap like that in a contract, so you wont bugger off, they know full well that other places wont wait that long.

Phone acas, they will tell you what your rights are, but I am pretty sure if its less than a year you dont have to work notice,.......or is it 6months??hmmm now you have me thinking.

I think 3 months is pretty steap! I've been wiv my current practice for 5 years and our notice period is 2 months. Althou I think our vets have to give 6 mths

I have only been there 7 months and my notice period is 3 months, I would never leave giving less than 4 weeks, although sending a text sounds appealing............

If you have worked for somewhere less than a year you dont have to give any notice, although this would not look good on you.

Notice is usually a month if monthly paid, a week if weekly paid and so on, and although employers can put into a contract more than that they cant by law hold you to it.

I wouldn't think so if it's in your contract, you could negotiate, also you could take any holidays you have left to cut down the amount of time you work there

If its in your contract then I dont think you can get out of it unless your boss has done something super bad towards you. The only option is negotiation

You can but obviously this would affect your pay, and may also affect any good relations you need with your current employer for future references etc. How long is the notice period required?
