Just wondering if anyone has any experience of leaving a job midway through working the notice period? Basically, I handed my notice in 2 weeks ago and since then the general attitude of one boss in particular has been appalling. She

Re: Leaving during notice period

As far as I am aware you are able to leave without working your notice. All of my contracts I have had have stated that I must give X amount of notice but either party can withdraw this notice period with good reason, double check in your contract, they basically put this in so that, if for instance you made a big mistake and they didn't want you working there at all, they can get you to leave giving you notice but not having you there (I think they generally have to pay you your notice if they do this but am not sure they will if you decide to go sooner). If things are that bad I would go to someone who is senior, explain the situation and say that you have given them your notice but are not prepared to work the rest of it due to this behaviour towards you. I know of someone who actually did this recently and whilst it is obviously frowned upon I am pretty sure that legally you can do it, but as I said, check the notice clause of your contract! Good luck!

Re: Leaving during notice period

Thanks everyone for your advice!

Re: Leaving during notice period

You definitely should not put up with this. If I were you I would write a letter and make a list of some examples of what she has done/said and explain that she is making it very difficult for you to perform your work duties effectively. I would also explain that if this behaviour continues on you will have no alternative but to finish early as it's causing you great distress. I would give this letter to another member of senior staff asking for it to be dealt with and if there is no improvement I would leave asap or alternately you could get signed of sick with stress. This woman is being incredibly unprofessional, so somebody should inform her that her behaviour is not acceptable. Also by putting your concerns in writing you are giving the other senior members of staff a chance to sort it out - if they don't and her behaviour continues there is no point in staying. Good luck!

Re: Leaving during notice period

Nobody deserves that!

I doubt she will take you to court, surely she'd be too worried about you coming out with how she has been treating you. I left a retail job a few years ago before my notice period ended and I just lost out on holiday pay.

Don't stand for it!

Re: Leaving during notice period

Why not call her up on it? Next time she screams at you tell her you will not be spoken to like that and how dare she treat staff in this way, then walk away. Go sit in your car for half an hour or something and go back in. If she does it again, say I've already told you I won't be spoken to like this, then go home.
Is she the only partner? If not when you go back in tell another partner if she does it again you won't be coming back to work. There is no way I'd tolerate this behaviour, it's disgusting!

Re: Leaving during notice period

Hi

Get in touch with ACAS, their website is www.acas.org.uk They will be able to advise you, including your rights to pay for work done, pay for holiday not taken etc. if you were to leave early.

If it were me, I'd be inclined to wait until next pay day, check I'd got everything I was due and call it there, but that's me...

Re: Leaving during notice period

my new employer is aware of the difficulties so I'm not worried about that, I'm more concerned that they could take me to court for breach of contract? Though whether they would be bothered to go to that expense and hassle I'm not sure..its a big risk though. I would love to resolve it and leave on good terms, but having seen a similar scenario acted out on previous members of staff (we have had 10 members of staff leave in 18 months!) I very much doubt there's hope for that. I'm wondering whether it would be less risk to just avoid her like the plague and wait it out, only another 5 weeks to go :S thanks for the advice so far guys!

Re: Leaving during notice period

but how would the new employer feel if they found out?
