I get 20 days holiday a year and work some bank holidays too. I worked Good Friday and also working the next one this month

Definitely you should get a day off in lieu. Just cos you get paid for the BH Monday, doesn't make a difference - you should be paid for holiday & if it's not taken as holiday, then you need another day off at another time - if that makes sense! (Made perfect sense to me, cos I know what I'm trying to say!)

I get 20 days holiday plus bank hols too so my employer is within the law as bank hols can be counted towards the 28 days statuatory hols. However, although we don't open on bank holidays, we might have in-patients staying with us and so the nurses share out the bank holidays between us. We get paid for the bank holiday at the normal hourly rate we would work that day and then we get paid time and a half for any time actually worked if we have to care for in patients. My question is... should we get a day off in lieu if we have to work a bank holiday? If I have to work 3 bank holidays, for example, I would only be getting 25 days actually off work. Or does the fact that I'm getting paid on top of the holiday pay cancel that out?

So in effect they cannot tell you when to take holidays, they can only refuse them with good grounds to do so.I usually talk to the horses mouth., certainly when it concerns me,......... or have been known to talk to an employment lawyer,(definitely when it concerns me) and they have given me great advice re night shift working and pay allowances, and I learned much more than I would ever have known from a website ....... so well worth the money folks., nothing wrong with a website for certain facts, but definitley worth speaking to someone on the phone in regards to any concerns and to get a more in depth knowledge and understanding of the facts especially if it is important to an individual person. In my case I wanted 1 day off for a funeral, and my boss refused, ven though no one was off at the time.That is when I called ACAS, and they basically told me what I have written above in regards to my rights as an employee...... incidentally I got my day off.

Forgive me if that seemed cheeky, it was not meant to, but to get my point across I felt that certain aspects should be pointed out.

If I am wrong then, I will definitely eat my hat brown sauce and onions if thats the case

I am sure under extreme circumstances, ie lack of work etc for a given place of work, at certain times, an employer can at that time tell them they must take their annual leave, but under normal working circumstances it would not stand.

I always thought that Good Friday is a BH but Easter Monday isn't a true BH although many people prefer to take Easter Monday and some lucky bods get both!

Fraid it is! Technically, your boss can tell you when to take your holidays. You are allowed to ask for specific times - but he is allowed to say no as long as he/she gives you notice. Obviously most bosses wouldn't do this (wouldn't keep staf for long) we just make requests, as STRVN said, as to when would be most convenient. But the law does stand. For clarification, see:

I dont think that is technically true, yes your boss can say that they would like x amount of holidays taken by certain times of the year, and places like factories that close at certain times, obviously you then have to take holidays then, but if you want a holiday and give notice of said holiday then you can take it when you wish.

A lot of places will obviously have to have x amount of staff working at a given time, so in some cases possibly only 1 or 2 people off at any time.

Notice periods for holidays, are usually double the time for the time you want off.

1 day, you give 2 days notice, 2 days 4 days notice

1 week, 2 weeks notice etc etc.

There was a new ruling that came into force on 28th April (i think, dont quote me on the date) that states everyone is entitled to 28 days holiday a year including bank hols, so that means 20 days hol and 8 bank hols. I guess previously to this the holiday entitlement was less than 28days so bosses could get away with only allowing 27....I'm no legal bod and im just going on a piece on information that somehow made its way into my brain....but if i were me id look more into it as im sure EVERYONE is entitled to 28days now

I used to work in a practice that also the boss made us work on good friday, saying that he didnt want the practice shut for four days over easter. We paid usual rates of pay with no extra time off.

Hmmm think Im wrong! Good friday is listed as an official bank holiday on the government webpage. Maybe my ex boss was just really tight!!

Im not 100% on this but Im not sure if good friday is a true bank holiday. A practice Ive worked in previously always made us work it. Will see if I can find out anymore info regarding this.

How much paid holiday can you take

You are entitled to a minimum of 5.6 weeks' holiday a year. This is called statutory holiday.

To work out how many days holiday you can take a year, you need to multiply 5.6 by the number of days you work in a week.

if you work a five-day week, you are entitled to 28 days' paid holiday a year (5.6 X 5).

if you work 2.5 days a week, you are entitled to 14 days' paid holiday a year (5.6 X 2.5).

The maximum amount of statutory paid holiday you can be entitled to is 28 days. This applies even if you work more than five days a week.

Your contract of employment may give you the right to take more than the statutory amount of paid holiday. However, it cannot give you less. For example, if your contract of employment says you can only take 10 days' paid holiday a year and you work five days a week, you will still be entitled to take 28 days' paid holiday.

If your normal working week is expressed in hours, your statutory leave may be expressed in hours too."
