Have you checked that HMRC have sent a code notification to your employer? Your employer can only use the code notified to them by HMRC.

I was therefore underpaid by about &amp;pound;40 at the end of April. I sorted this out with the accountant, gave her a copy of the letter I had received from HMRC as proof of the new tax code and promised I would get the outstanding in my next pay, at the end of May. I wasn&amp;#39;t thrilled as&amp;nbsp;I only work part time so &amp;pound;40 makes quite a difference to my take home pay but I just went with it. Last week, when we got paid for May, the same incorrect tax code had been used and I was down the same amount again. I emailed my boss and my payslip got adjusted (correctly and including April&amp;#39;s underpayment) later the same day, so I can&amp;#39;t complain about nothing being done. However, as&amp;nbsp;I am now down nearly &amp;pound;80, plus I am owed last week&amp;#39;s expenses of around another &amp;pound;80 (last week was my final week in this job as&amp;nbsp;I start a new one tomorrow), I am desperate for my money. I&amp;#39;m secretly quite p&amp;#39;d off that the April amount has already spent an extra month sitting in my boss&amp;#39;s bank account rather than mine although I haven&amp;#39;t said that to her.&lt;/p&gt;
&lt;p&gt;My question is, can they legally make me wait until the next time she is doing wages (ie end of June) to pay me what they owe, in which case, part of it will be two whole months late, or can I insist on getting it sooner? I don&amp;#39;t think there&amp;#39;s anything malicious here and am sure&amp;nbsp;I will get it eventually as the wages have always been a bit erratic in terms of exact pay date etc but I&amp;#39;m just desperate to get my hands on the now outstanding &amp;pound;160 (or thereabouts) asap!!! &lt;/p&gt;

You&amp;#39;re right it isn&amp;#39;t always the case, rebates and bills usually occur because someone has had the wrong tax code all tax year or mistakes have been made with no action taken to sort it, tax code wasn&amp;#39;t corrected until after the tax year etc. 



Being on maternity leave (or less pay for any reason) shouldn&amp;#39;t be too much of a factor. Basically, when tax is calculated the calculation looks at: a) how much you have earned in the current tax year, b) how much (according to your tax code) of your earnings should have been tax free and c) the amount of tax you have paid on these earnings and how much tax you should have paid.  As an example; if you earned £5,000 and should have paid £1,000 tax but actually paid £1,200, when the tax code gets sorted the £200 over payment should reduce the next pays tax. Problems can also occur when people don&amp;#39;t have one of these cumulative codes and have what is called a week one/month one code - these only look at the individual weeks/months pay but tax rates and allowances are based on annual amounts. 



I actually got under taxed in April because our payroll over increased the tax codes for the new tax year, I noticed this and raised a query. When payroll was run for May the tax increased slightly in the month to compensate, this month it was back to what it should have been in the first place. I don&amp;#39;t work in a clinical role anymore and have worked on payroll for a previous employer including dealing with code issues and HMRC, we had some one once who&amp;#39;s tax went negative for a couple of months (she was being paid tax back) due to a problem with her code.

The money won&amp;#39;t be sat in your bosses bank account, they would have paid it over to HMRC.

Most tax codes are what is called cumulative, that is too say the calculation of your tax (if any) is based on earnings throughout the tax year, so the calculation constantly corrects itself for any under or over payments. In short, if you have over paid tax (or ever underpay) due to a wrong code then once the correct code is applied the tax calculation will be such that the amount owed to you is added back in - this will apply even if you change employers.

It was a permanent job, it&amp;#39;s just that i happen to have finished last week to start a new job. &lt;p&gt;But an ongoing problem for locum nurses that go PAYE for lots of short term jobs. I often got tax rebates at the end of the financial year because I had too much tax taken from me during a locum!&lt;/p&gt;
