&lt;p&gt;The law is a vacuum in which, as there is no definitive protocol to follow, the situation defaults to the law concerning property and theft. As such, there is no fixed legal period like there is for stray dogs - theoretically an owner could make a claim weeks or months in the future, and in fact we do get involved in such claims in respect of cats we rehome occaionally.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;All you can do is ensure you have taken every step to find an owner - report the cat to local charities who have a lost &amp;amp; found facility, scan it (whole cat) for a chip, make sure posters are put up. If the cat isn&amp;#39;t in your care yet then a paper collar bearing a message is a good idea for a few days as well. We do this at CP routinely.&lt;/p&gt;
&lt;p&gt;While this isn&amp;#39;t bombproof, it does establish to a court that there was no intention to deprive an owner of&amp;nbsp; their cat - the legal definition of theft in law is &amp;quot;deliberately misappropriating property belonging to another with the intention of permanently depriving the other of it&amp;quot;. Hence if the finder or rescue can show they have tried to locate an owner, then there is no criminal offence of theft.&lt;/p&gt;

This happened with a cat I took on. Very distinctive looking and was brought in as a stray RTA and was immediately recognised as a cat we had in just the week before for castrate ( further confirmed by having a quick look under his tail for the bald bits and two scabs). &lt;p&gt;I contacted the SSPCA and they couldn&amp;#39;t help me, they told me to contact a solicitor or CAB. &amp;nbsp;One of the partners wrote off a letter today that we&amp;#39;ll get sent recorded delivery tomorrow.&lt;/p&gt;

If they haven&amp;#39;t heard back in that time then they change the name on the microchip so I would work on these parameters. In the end we sent them a recorded letter stating it would be rehomed if not collected by certain date. No contact so cat was eventually rehomed to someone who knew the sutuation and lived a long way from the previous owner. In the situation you&amp;#39;ve described, what we would have done at the RSPCA would be to write a follow up letter stating that &amp;quot;following our conversation with you on... when you stated that you would collect her from the surgery on... and did not show up or contact us, we have no option but to set a deadline of... for you to contact us to make arrangements for collection, otherwise we have no option but to rehome her as we are a veterinary practice and do not have facilities to board stray cats long term&amp;quot;. That way, if he decides in a month&amp;#39;s time that he wants her back and she was microchipped so legally his, you can prove that you did everything reasonable to try and reunite them and cannot be accused of being unreasonable and you have the proof in writing, not just his word over yours by phone conversation.
