&lt;p&gt;ok having just re read this - yes she could be in breach of contract,&amp;nbsp; if her notice was worded how you have written it, if contract stipulates a months notice and she has only given 2 weeks - it doesnt matter that she is owed 2 weeks holiday she hasnt fullfilled her contractual obligation.&lt;/p&gt;

If she has given a months notice it is up to the employer if they decide to let her leave 2 weeks early or they make her work the month and then pay two weeks holiday pay.
