The thing that makes it worse is we now think our boss was definately pushed into it by the other vet because he's trying to help her find a new job!! How many bosses would do that if they'd just fired you?!!!

Re: Termination of Contract

Not after 5 years. I would say she has watertight rights if the resignation had to be in writing to count.

Re: Termination of Contract

I think she has to resign in writing, so verbal does not count as a resignation. Is she here on a work visa, or a permanent resident?

If the locums are registered/listed nurses, then they probably could say that this is what they are looking for and no longer require her... I think they would probably get away with that if push came to shove.

Re: Termination of Contract

My grumble about it is that they did accept her withdrawl! They were over the moon that she was staying!!

We did wonder if it was because the RCVS said no but our head nurse isn't registered either...in fact...I'm the only nurse in the building who is (and I leave next friday!)

Re: Termination of Contract

if she has resigned then they technically do not have to accept a withdrawl of the resignation. if the locums had been organised during the time she was waiting for the RCVS to get back to her then technically they have someone else to do her job and have no need for her.

If I had been her I would have waited for the rcvs to get back to me before I even verbally resigned

Re: Termination of Contract

I think it would also depend on the type of contract she has, if she has signed one at all, if there were conditions against the contract (such as RCVS then if she's been denied this they would be within their rights (i believe!) to terminate the contract, because the conditions haven't been met.

Also if she's in probation period of a contract I think either party can terminate this for any reason with a week notice... again, check the contracts...

Re: Termination of Contract

I am not 100% clued up on employment law, but I was under the impression that if you fire someone 'because you don't need them' you cannot hire someone to do their exact job. So if they are firing someone, and bringing in locums to do her job, I would assume this is not acceptable. She should contact citizens advice, they are usually really good at helping out with this stuff.
